The Employment Ordinance states that a contract of employment may be terminated by the employer or employee through giving the other party due notice or wages in lieu of notice. The length of notice required depends on the employment condition of the employee. In the case of continuous contract of employment, when the contract is terminated by the employer during a probationary period of an employee, a one week notice should be given if the length of service is longer than one month.
Meanwhile, it is eligible for employee to claim compensation for the annual leave pay, which is proportional to the serving day of employment. The calculation is as follows.
Annual leave Days entitled in the current leave year * [period of employment (days) / 365]
