7天內離職,薪金如何計算

您好,為了更詳盡了解個案。
現補充合約上之內容以作分析。

The employee will be entitled to public holidays based on the Statuory Holidays in accordance with the Employment Ordinance. Sunday is the rest day. And Saturday is considered as a regular day off and not statutory rest day.
If a public holiday happens to fall on a Sunday, staffs will not be compensated with an alternative rest day or payment in lieu.

During propation, there will be no payment for banking / satutory holidays and the same shall be withheld from the salary on a pro-rata basis until confirmation of employment after probation period.

由於 2/8 及 3/8 (星期六,日) 是本人之休息天,根據合約上之內容,2/8(六) 應被理解為 a regular day off and not statutory rest day. 而合約上列明試用期內,銀行假及法定假期是無薪的,但並無寫明 regular day off 無薪。
所以僱主應支付 2/8 (六) 之薪金給我,對嗎?

如合約沒有明列休息日無薪,而閣下是月薪制,休息日便需要計薪了,如公司欠付休息日薪金,閣下可以向勞工處投訴,如閣下需要本會協助,可致電:27793766高先生/蔡先生
